Terms of Service

1. Agreement

By creating an account on Never Miss A Call (“the Service”, “NMAC”, “we”, “us”) you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service does

NMAC is an automated missed-call response service for Australian tradespeople. When a caller rings your business number and you don't answer, your carrier forwards the call to a dedicated number we've assigned to you; we answer, play a brief greeting, and send an SMS to the caller so you don't lose the lead.

3. Eligibility

You must be at least 18 years old and authorised to enter this agreement on behalf of your business. The Service is intended for use within Australia.

4. Your number

We issue you a dedicated Twilio-backed phone number for inbound forwarding. This number remains our property; if your account closes, the number returns to our pool.

5. Subscriptions and trial

Paid plans are billed monthly in AUD via Stripe. New accounts receive a 14-day free trial. You can cancel anytime through the customer portal; access continues until the end of the current billing period. Prices are subject to change with 30 days' notice.

6. Acceptable use

You agree not to: use the Service for unlawful purposes; send spam or unsolicited commercial messages; impersonate another business; attempt to disrupt or reverse-engineer the Service. We reserve the right to suspend accounts that breach these rules.

7. Limitation of liability

The Service is provided “as is”. We do not guarantee 100% uptime. We are not liable for business losses resulting from missed SMS replies, carrier outages, or third-party dependencies (Twilio, Anthropic, Stripe, Supabase). To the maximum extent permitted by law, our total liability is capped at the fees you paid us in the preceding 3 months.

8. Termination

You may cancel at any time. We may terminate accounts for breach of these Terms with notice.

9. Changes

We may update these Terms; material changes will be notified by email with at least 14 days' notice before taking effect.

10. Governing law

These Terms are governed by the laws of Western Australia, Australia.
